Nurses aren’t generally restricted from entering bankruptcy either.

This applies whether you work for the NHS or privately.

Personal insolvency should not affect your registration. For nurses and midwifes, it should not lead to disciplinary action. If there’s no connected criminal issue, there should be no problem.

Personal debt isn’t mentioned in the NMC’s Code.

Check Your Contract Of Employment

Check your contract for any personal insolvency clauses. Most nurses will not have such clauses in their employment contract.

This may be different if you hold budgeting responsibility. If budgeting is part of your role, proceed with more caution.

Support From Your Union

If you’re a member, we suggest contacting your union. It’s likely they will have supported colleagues dealing with debt.

This may provide reassurance to you. They probably know of colleagues that have entered a trust deed. They’ll be able to assure you your job will go unaffected.

Other Debt Solutions

Nurses in Scotland aren’t restricted to using trust deeds or bankruptcy.

There are two further options to get extra time to repay your debt. They can reduce your monthly repayments.

A debt arrangement scheme may be suitable. It provides legal protection while you repay your debt. It guarantees interest and charges will stop.

A debt management plan is more flexible. It doesn’t provide legal protection from creditors though.

These options are often used by homeowners.

Getting Debt Advice

We’ve helped many nurses to deal with their debts.

For friendly confidential debt advice, please get in touch.

Can a nurse in Scotland tackle their debt using a trust deed?
